Tech executives and artificial intelligence companies face severe scrutiny following a historic election that handed Democrats control of both the House and Senate starting in January. Democratic lawmakers are preparing for aggressive oversight, including numerous subpoenas, investigations into Elon Musk’s Department of Government Efficiency (DOGE) cuts, and stricter guardrails for data centers and AI safety.

Intense Oversight and Subpoenas Planned

Democratic leaders made their intentions clear shortly after election networks projected their majorities. A top Democrat on the House Oversight Committee posted a message on X telling corporate corruption and the Trump administration to lawyer up, while Senate Finance Ranking Member Ron Wyden simply posted about subpoenas. Sen. Ed Markey responded to a comment about live televised trials of Big Tech executives by stating that new forests would need to be planted for all the subpoenas Democrats will be printing.

Rep. Greg Casar, chair of the Congressional Progressive Caucus and an Oversight member, stated that AI company CEOs should be required to testify under oath. He called the revolt against data centers a top issue of the 2026 election that will soon be viewed as an early tremor of a much larger AI earthquake upending American politics. Meanwhile, Rep. Frank Pallone pledged to advance policies that protect consumers and the environment, prioritize clean energy, and rein in Big Tech, and Sen. Bernie Sanders has called for a pause on artificial intelligence.

Democrats previously used their minority position to signal their upcoming committee agendas, such as a shadow hearing held by House Judiciary Committee Ranking Member Jamie Raskin after the Justice Department settled its Live Nation-Ticketmaster antitrust trial. Raskin told reporters at the time that building a record early is necessary because administrative corruption is overwhelming. More recently, Raskin requested information from Amazon, Google, Meta, and Oracle regarding nondisclosure agreements for public officials considering data center proposals.

Targets Include Elon Musk and AI Guardrails

Lawmakers are eager to investigate Tesla and SpaceX CEO Elon Musk, who spent record amounts trying to elect Republicans and served as the public face of DOGE, slashing federal jobs and eliminating the USAID soft diplomacy arm. Prominent Democratic lawmakers told Politico they are eyeing Musk’s DOGE role, alleged conflicts of interest, and his reported disruptions of Starlink service in Ukraine.

Rep. Sam Liccardo stated in an interview with The Verge that while probing DOGE is necessary, his party must bring actual solutions rather than endless calls for CEO testimony and performative ranting. Liccardo believes AI safety rules should top the tech agenda, followed by data centers and AI impacts on jobs. TD Cowen’s Washington Research Group noted that President Donald Trump will likely veto any AI safety bill that slows down the AI model release cycle, and that antitrust legislation may stall before reaching a floor vote or face a veto.

Despite potential resistance from Trump, Liccardo believes Congress can secure the president’s signature if they build enough bipartisan support by demonstrating strength, much like what happened with the Epstein files. Trump told The New York Times he aims to work with Democrats, leaving a potential path for measures with broad support. The Kids Online Safety Act, which passed overwhelmingly in the Senate in 2024 before being blocked by House Republican leadership, could potentially pass the House if given floor time.

Sen. Richard Blumenthal emphasized that Big Tech’s lawless disregard for children and communities remains a top priority, noting the issue has always been bipartisan. Rep. Jake Auchincloss added that Democrats should pass legislation making app stores responsible for age requirements to keep children under 16 off social media.

Data Center Hurdles and Industry Reactions

Data center developers are expected to face significant obstacles that will slow their rapid expansion. Yorkville Ives analysts wrote that Democratic control of the Senate creates major hurdles for AI and tech legislation, forcing Big Tech CEOs to the negotiating table to compromise on AI-related laws.

The Chamber of Progress warned Democrats not to confuse an anti-Trump wave with an anti-tech mandate, noting that Democratic gubernatorial candidates opposing data center bans won at higher rates than supporters. Liccardo hopes to leverage data center buildouts to force developers to invest in necessary energy grid upgrades.

Anthropic may receive a slightly warmer welcome in Congress after standing up to the Pentagon when asked to let its AI be used for domestic mass surveillance and autonomous weapons. Although the company will still face skepticism regarding its AI safety proposals, its recent positioning helps differentiate it from peers.

Democratic messaging has heavily shifted toward a Big Tech and AI crackdown, with spending on political ads referencing tech keywords surging from about $2 million across six ads between 2020 and 2024 to more than $100 million across 387 ads between 2025 and 2026.
